I've recorded all of the last few days worth of calls, and let them know. I've been given the option to transport the car to any shop or adjuster of my choice (initially at my own expense, unless the value (ACV) ends up being greater). So, that option is on the table.

CCC's evaluation, dollar wise, was surprisingly spot on, for the items they listed.
that is good.

At multiple points in my prior negotiations with my insurance company, let them know I was prepared to force them into a formal adjuster process whereby they hire another adjuster and I hire my own for them to get into the virtual ring and come up with a settlement. They generally hate that since it costs them more money than they plan on.

BTW - NYS is a one party consent state.

my conversation on "value " went like this >>>
I do not care what book or system you use, I live in real world... So plese provide me a list of 3-7 cars actualy available for sale in 250 mi radius from me with same mileage (or less), same year or newer, same make model and trim, and options
I do not ask anyting special, just fair replacement cost
6 hours later adjuster sent me 6 printouts with new average of $4K more...
P.S My my car was totaled and I was not trying to make them fix it..

Thanks to the wonderful people like Dan at @Liberty Subaru, that may become my backup plan. Going to call the bank in the morning, and see if they can do a loan mod to swap vehicles on the loan - and failing that, Tom Portee (that wonderful Finance Manager who rightly has a five star customer rating; even when most auto finance people are usually loathed, lol!) may be able to figure something out.
Was talking about you to Tom just ~2 weeks back when we ordered our 23 Ascent. Good luck Robert.

Hopefully you can come off the loaner Ford soon.

CCC One Market Valuation Report. The numbers seem fair - except of course for the items they didn't include.

The problem, of course, are the thousands of dollars of factory order accessories they did not include - not to mention some of my upgrades.

something is amiss. Your own original valuation of the vehicle without the additions was 24-25000 tops. they came in at 26500. My guess is the source you used. NADA? the current market valuation is difficult given the supply chain and financing constraints for many.

Tom at Liberty can probably look up the blackbook value. Dealerships frequently will use this resource. Together with Edmunds you can probably come close to its value not including the more unique add-ons.


How much were you and State Farm deducting for mileage? I do not recall your mileage but I am guessing the deduct is about $8000.

A local dealer in Denver metro is selling a 2019 Touring with 51000 for $35000.
Another dealer has one with just 30000 for $39500

no other metro dealers have them. An occasional one will pop up.

I think after the mileage deduct and assuming good condition otherwise with exccellent mechanic condition plus your extras (of which I do not know all of them), I would think it could bring in the mid $30000s or possibly higher.

The insurance company is going to fight theirs, so, there is that. But at top of the range, my car is worth $24-25K, thanks to 92,185 miles and some trail striping.

If I ever started doing this to make money, it'd probably be wise to make whatever car into a corporate car.

That was accurately done, and the value they quoted (for the options they listed) is in line with the higher end of the market value. I could buy a similar Ascent with similar miles (a thousand more?) with less pin striping for about the same price or a little less, right here in NYC Metro, right now.
Good laws to know. You don’t always have to tell another party you’re recording them.
Virginia is a single party state also, but since I’m not always with my car there is a sticker in the door jamb stating consent to recording is given by entering the vehicle.
Yep. I did anyway, because I wanted them to be aware I'd be able to use every single verbal promise they made to ensure they gave me what they were promising. They kept on making promises anyway - though, again, this was after I made a post on my FB page.

Hey, Robert, any updates for us on the fate of your beloved/famous car? I know that there's a lot of us on here that have been rooting for you to get the best outcome possible, for your story truly deserves a happy ending.

Hi all, State Farm practically forced me to buy it back as a salvage. But, at least my social media post got them to send one of their own adjusters out there to re-value my car. That raised the value by $6,000, and put that at under 60% damage (threshold to total is 75%). They started to let me know they'd find more damage that costs thousands, and thus wanted to total it.

So, I bought it back as a salvage, and took the extra cash and put it aside to get it fixed properly by another shop.

Alas, everyone is booked until November, so, it's in storage, in PA, until the body shop I chose is ready for it (it's one that does a bunch of Subies for a friend, and that's done another Ascent with near identical damage).

So, with luck, I might see it again by the end of the holidays.

BUT, I WILL see it again, so, there's that.

In the meantime, I save up some more dough, so I have less on the credit card once the insurance money runs out - and I will get lots of bicycling in. Good news is, I was supposed to start biking to the train station on my "work in the city" days, a full year ago. Now I have to, lol!!!

Thanks for updating us, Robert. Glad to hear that you'll eventually get it back, for it's truly legendary, but I feel your pain as far as having to wait to very long to get it back. Frustrating that one stupid driver at just the wrong moment can end up causing such extended aggravation. Sigh... In the meantime, though, I hope the biking to work thing goes well, and may the weather gods smile upon you during that time.

Well, the one thing I have to say about the driver (and six passengers) is that they were honest. Not just did they admit fault, but, then State Farm, before their final "0% at fault, other party 100% at fault" verdict was waiting on their dash cam footage, and, they indeed turned over their footage proving they were 100% at fault.

Sucky it happened, and I am missing a lot of events this late summer and fall, but, I guess accidents happen, and I am happy that she was beyond honest about it, even turning over the proof against herself.

Honesty like that seems exceedingly rare these days, so you definitely were at least lucky in that regard.

@Robert.Mauro glad to ear that you will eventually get your car back. I have a question regarding starlink. (If you have a starlink subscription) When you got into the crash, did starlink call emergency for you, did they detect the crash, did they call you to ask if you were ok, etc… I am curious about the all process in case of an emergency. Do you know what I mean?

I had them call the police, told them I was ok. They then asked if anyone else was involved and if they needed ambulance/medical attention, as I was ducking out under the airbags to check. While I did that, they got the police on the line in a three way call and got them started with what they needed to be on their way. I came back to let them know no one wanted medical attention, helped with visible landmarks, and they stayed on with me until police were on their way and off the phone, and asked me if I wanted them to stay on with me while I waited. I let them go at that time.

I had them call the police, told them I was ok. They then asked if anyone else was involved and if they needed ambulance/medical attention, as I was ducking out under the airbags to check. While I did that, they got the police on the line in a three way call and got them started with what they needed to be on their way. I came back to let them know no one wanted medical attention, helped with visible landmarks, and they stayed on with me until police were on their way and off the phone, and asked me if I wanted them to stay on with me while I waited. I let them go at that time.

Having been through all this, (unfortunately) how would you rate State Farm & how they handled it? Does it make you want to look for another company or are you satisfied with them & the outcome?
